    I hate railroad tie landscaping! One of the biggest and heaviest pain in the asses when it comes to removal. I recommend a 12" demolition blade for your recip saw (if you're a homeowner doing the removal and disposal, at least.) Even then it's a PITA!

    BIGGEST problem NOT addressed… If you look real close, you'll see it. From edge of garage to retaining wall was gravel. Good idea. The TWO LAYERS of plastic with a grade leading to the retaining wall… NOT GOOD. ALL the water from the roof was funneled straight to the back side of the wall and allowed for it to rot from the back side outwards. No plastic protecting the back side of the retaining wall at all, which could very well have been hidden between the top course and second down so you'd never have seen it at all (two layers should have been placed) … Poor construction initially by whomever built it.

    I also noticed that the driveway was never backfilled properly, which now gives the water a sort of river effect therefore eroding the surface area between the driveway and wall even more. My assumption is that the existing grade on the uphill side was probably lower than the top most rail road tie… so instead of shedding, it ate its way down and also had the un-backfilled drive trapping it there.

    Railroad ties are used & rotten to begin with!  I do not see the garage having much to do with the failure.  Yes gutters would deflect the water but it would have just moved the water to the front & back of the garage.  The wall failed because of rotten RR ties and age!

    I am Surprised that the Building Inspect didn't say anything about the wall before the Garage was built and then after the Garage was built about not have a place for the water to travel too the Street !

    both homes (not home owners) are at fault
    the one home is sub grade to make a flat home pad
    and the other is above grade
    the "ONLY solution" is to bore a cement retaining wall,
    under the upper pad and replace the retaining wall with cement and drainage
    the slope idea is reasonable but forces all water upon the lower home
    you need more experience to give advice in court
    you are totally ignorant of liabilities
    in the present and future,
    both home owners should pay for retaining wall refurbishment
    and home owner on raised pad should make effort for surface water control
